Terms & Conditions – Alexander Adventures Ltd

1. Introduction

These Terms & Conditions (“Terms”) apply to all bookings made with Alexander Adventures Ltd (“we”, “us”, “our”).

By making a booking, you confirm that:

  • You have read, understood, and agree to be legally bound by these Terms
  • You have the authority to accept these Terms on behalf of all persons included in your booking

These Terms constitute the entire agreement between you and us and supersede all prior communications, representations, or agreements.

2. Booking and Payment

A booking is confirmed only upon receipt of the required deposit or full payment.

  • The balance must be paid in full by the specified due date
  • Failure to pay may result in cancellation without notice and forfeiture of any payments made
  • We reserve the right to refuse or cancel any booking prior to confirmation
  • Prices may change prior to confirmation but are fixed thereafter, subject to Clause 2A

2A. Price Adjustments (Fuel and Currency Fluctuations)

Prices are based on costs at the time of booking, including fuel, transport, accommodation, and exchange rates.

We reserve the right to apply reasonable price adjustments after booking but before the balance due date where increases arise from:

  • Fuel or transportation cost increases
  • Currency exchange rate fluctuations
  • Government taxes, levies, or third-party supplier charges

Where such changes occur:

  • We will notify you as soon as reasonably practicable
  • Any surcharge will reflect the actual increase incurred
  • If the increase exceeds 10% of the total booking cost, you may cancel and receive a full refund

No price increases will be applied after the balance due date.

3. Cancellation by You

All cancellations must be made in writing and take effect upon receipt.

Cancellation charges:

  • More than 60 days: Loss of deposit
  • 30–60 days: 50% of total cost
  • Less than 30 days: 100% of total cost

No refunds will be given for:

  • Non-attendance
  • Late arrival
  • Voluntary withdrawal
  • Failure to meet travel or entry requirements

These will be treated as cancellations under these Terms.

4. Changes or Cancellation by Us

We reserve the right, at our sole discretion, to cancel, amend, or reschedule bookings where reasonably necessary.

This includes (but is not limited to):

  • Weather or environmental conditions
  • Safety concerns
  • Staff or guide unavailability
  • Insufficient participant numbers
  • Force Majeure Events

Where possible, we will offer:

  • A rescheduled date; or
  • An alternative of comparable value

Where a rescheduled date or suitable alternative is offered (including due to weather or safety conditions), this constitutes full performance of our obligations and no refund will be due.

Refunds will only be considered where no reasonable alternative is available and will not exceed the amount paid.

5. Weather and Safety

All activities are subject to suitable weather and environmental conditions.

We retain absolute discretion to:

  • Modify, relocate, or shorten activities
  • Substitute elements of an itinerary
  • Postpone or reschedule activities
  • Cancel activities where necessary for safety

Where activities are rescheduled due to weather or safety:

  • Your booking will be transferred to a new date
  • No refund will be provided where a reasonable alternative is offered

All safety decisions are final.

6. Rescheduling

If your booking is rescheduled (including due to weather, safety, or operational reasons):

  • Your booking remains valid for the rescheduled date
  • These Terms continue to apply
  • No refund will be issued where a reasonable alternative date is offered

If you are unable or unwilling to attend the rescheduled date, this will be treated as a cancellation by you under Clause 3.

7. Participant Responsibilities, Medical Disclosure, and Conduct

By booking, you confirm that:

  • You are medically and physically fit to participate
  • You will disclose all relevant medical conditions, injuries, disabilities, or limitations at the time of booking or as soon as they arise
  • You possess the necessary level of fitness, ability, and experience required for the activity
  • You will follow all instructions and safety guidance

Undisclosed Conditions or Inadequate Ability

If you:

  • Fail to disclose a relevant medical condition; or
  • Misrepresent your fitness, ability, or experience level; or
  • Are deemed by us to be unfit or unable to safely participate

We reserve the right to:

  • Refuse participation; or
  • Remove you from the activity at any stage

In such cases:

  • No refund will be provided
  • We accept no liability for any resulting costs, losses, or consequences

Alcohol and Drug Policy

Participants must not be under the influence of alcohol, illegal drugs, or any substances that may impair judgment, coordination, or ability to participate safely.

We reserve the absolute right to:

  • Refuse participation to any person suspected of being under the influence; or
  • Remove any participant from an activity where their behaviour or condition poses a risk to themselves or others

In such circumstances:

  • The decision of our staff is final
  • No refund will be provided
  • We accept no liability for any resulting costs or consequences

Where alcohol consumption forms part of a wider experience, it must be consumed responsibly and only at times permitted by our guides or staff.

8. Assumption of Risk

You acknowledge that adventure activities involve inherent risks, including serious injury or death.

You voluntarily accept these risks, except where caused by our negligence.

9. Insurance

You are strongly advised—and for international expeditions, required—to obtain appropriate insurance.

10. Liability

Nothing in these Terms excludes liability for death or personal injury caused by negligence.

Subject to this:

  • We are not liable for events beyond our control
  • We are not liable for indirect or consequential losses
  • Our total liability is limited to the total amount paid

11. Provision of Services (Consumer Rights Act 2015)

We will provide services with reasonable care and skill.

Changes or delays due to external factors (including weather or safety) do not constitute a breach.

Where a suitable alternative is provided, our obligations are fulfilled.

12. Credit Notes

Credit notes may be issued at our discretion:

  • They have no cash value
  • They are non-transferable unless agreed
  • They do not imply liability

13. Complaints

Complaints must be raised as soon as reasonably possible.

Failure to notify promptly may affect our ability to resolve the issue.

14. Governing Law

These Terms are governed by the laws of England and Wales.

Courts of England and Wales have exclusive jurisdiction.

INTERNATIONAL EXPEDITION CLAUSES

15. International Travel Requirements

For international bookings, you are solely responsible for:

  • Passports, visas, and entry requirements
  • Vaccinations and health compliance
  • Legal compliance in destination countries

Failure to comply will be treated as a cancellation with no refund.

16. Flights and Third-Party Services

We act only as an organiser of activities unless stated otherwise.

We are not liable for:

  • Flight disruptions or delays
  • Missed connections
  • Third-party service failures

Any resulting costs or losses are your responsibility.

17. Force Majeure

We are not liable for events beyond our control, including:

  • Weather or natural disasters
  • Pandemics or government restrictions
  • War, terrorism, or civil unrest
  • Transport or infrastructure failure

In such cases:

  • We may modify or cancel bookings
  • No compensation is payable
  • Refunds are limited to recoverable amounts only

18. Itinerary Flexibility

Adventure travel requires flexibility.

We may:

  • Modify routes, accommodation, or activities
  • Change guides or schedules

No refund is due where a substantially equivalent experience is provided.

19. Mandatory Insurance (International)

For international trips, insurance is a condition of participation.

It must include:

  • Medical and evacuation cover
  • Cancellation and curtailment
  • Personal injury

Failure to provide suitable insurance may result in refusal to participate without refund.

20. Medical and Evacuation

You consent to emergency treatment and evacuation if required.

All associated costs are your responsibility.

We are not liable for the quality, availability, or timeliness of medical care.

21. Enhanced Limitation of Liability

We are not liable for:

  • Travel disruption
  • Third-party failures
  • Participant non-compliance
  • Force Majeure Events

Liability remains capped at the total amount paid.
